How Should I Prepare for My Mediation?

It’s a good idea to consult a lawyer first if you can. The lawyer doesn’t necessarily have to come with you to the mediation, but he or she can help you organize your thoughts and be prepared for the mediation. With or without a lawyer, though, you should carefully sit down and consider the most important parts of your dispute and what you want out of the settlement process because it really is a settlement process.

You should be prepared to present those important thoughts and what you want out of the mediation at the mediation itself. Of course, to listen to the other side and to listen to the mediator in deciding whether you want to modify your requests to arrive at a settlement that will end up as a binding contract upon all the parties.
