By law in most States, a data breach that has compromised your information, you must be informed of a central compromise. If of course the compromise results in personal injury, direct injury to you, for example your bank account is cleaned out as a consequence of that, you may then be able to bring a lawsuit against whoever has affected the compromise or the data breach.
