What Is Mediation?

Mediation is a way of resolving disputes between people without going to court and without a formal process. It’s far more casual and basically, it entails the parties getting together at a scheduled date, time, and place under the supervision of a mediator. The mediator doesn’t have to be a judge or a lawyer. It can be a well-trained civilian. The mediator’s job is to be neutral or impartial in helping the parties talk to each other in talking with each of the parties may be separately to come to a resolution of the dispute.

If the mediation is successful, then an agreement is reached, which is put in writing and signed by the parties. That agreement becomes a contract, which is binding upon them but if the parties are unable to come to an agreement, then they can simply walk away from the mediation process with no other consequence.
